MJ Miller Law is proud to be a LGBTQIA+ friendly law firm. We are committed to helping LGBTQIA+ clients through unique needs. Examples include non-biological and second parent adoptions, custody and support of children with LGBTQIA+ parents, and dissolution of marriages and partnerships. We also assist transgender and non-binary individuals complete legal name changes and receive corrected birth certificates.
Our firm is also very experienced with minor guardianships and grandparent visitation. Guardianships are granted when a child’s parent(s) are unable to care for the child. A legal guardian–such as a grandparent or adult relative–temporarily assumes the role of the parent and has the right to make decisions for the child. Divorce and Legal Separation
Divorce is never part of the plan. Even if you and your partner are on good terms regarding the end of your marriage, you should seek the help of legal counsel. Child Custody
As a parent, your child’s safety and well-being are always your primary concern, and family law judges will similarly focus on the best interest of the child/children when making custody decisions. Nevada’s best interest factors (which can be found under NRS §125C.0035) outline exactly what the Court takes into consideration when making a custody decision. Guardianships
A minor guardianship is sought when parents cannot meet the basic needs of their children. At MJ Miller Law, we have helped many clients through the guardianship process. Child Support
Child support can be the most contentious and stressful aspects of the divorce process. Child support calculations are set by statute and can be found under NAC 425. When determining child support the Court will look at both parties’ gross income. But what counts as gross income? Do your bonuses count? Does your overtime count? What happens if there is a significant change in income? It is important to speak with a knowledgeable and experienced attorney to determine what is and is not considered income for purposes of calculating child support. LGBTQIA+ Family Matters
As a member of the LGBTQIA+ community, Mikye J. Miller is a passionate advocate for LGBTQIA+ families. Nevada is a progressive state in terms of LGBTQIA+ rights. Domestic partnerships are handled just like marriages in Nevada, and the process for dissolution of a partnership is identical to that of a marriage. This includes settlement of assets, debts, partner alimony, child custody, and child support. Gender diverse individuals can also seek legal name changes and corrected birth certificates to reflect their gender identity. LGBTQIA+ rights vary state to state, so it is important to have a conversation with an attorney to protect you and your family.
